CTOA Raises Concerns Over Targeted Driver Misclassification Inspection Blitz

The Canada Truck Operators Association (CTOA) is raising concerns about the scale, timing and geographic concentration of federal enforcement activity concerning the classification of truck drivers as independent contractors.

CTOA fully supports compliance, safety enforcement and protections for workers. At the same time, the association says enforcement must be fair, transparent and based on facts.

Over the past week, more than 60% of CTOA Toronto-area members reported receiving Employment and Social Development Canada inspection notices, with many given only 48 to 72 hours to comply.

CTOA is asking why a program described as national appears to be concentrated heavily in Ontario and the Greater Toronto Area, including among ethnically diverse, immigrant-owned and family-run trucking businesses.

The association is also questioning the timing of the blitz during peak shipping season, when carriers are already dealing with freight-volume pressure and trade uncertainty.

CTOA warns that a poorly implemented enforcement campaign risks creating panic among drivers and small carriers, disrupting freight movement, slowing deliveries, pushing responsible small businesses out of the market and affecting the broader GTA economy.

CTOA Position

CTOA supports strong enforcement against real violators, clear rules, proper classification and a fair labour system. Misclassification concerns, however, should not be used to treat an entire region or community as non-compliant.

Compliance must be based on facts. Education, clear guidance and collaboration can produce better outcomes than punitive enforcement applied without adequate transparency or transition.

CTOA Calls for Clarification

CTOA is asking the federal labour authorities to clarify whether the inspection program is national or regional in scope, why GTA companies appear to be disproportionately affected, how businesses were selected for inspection, why the blitz was initiated during a peak freight period, and whether the potential supply-chain and small-business impacts were assessed.

CTOA will continue supporting responsible compliance while advocating for fair, consistent and practical enforcement across Canada.
